This Clarification Text was prepared by SystemNOW Mehmet KONT (SistemCloud) on the Personal Data Protection Law No. 6698 (“Law”) (Date of Adoption: 24/3/2016 | Date of the Official Gazette Published: 7/4/2016 Number: 29677) It has been prepared to inform you about the purpose, scope, duration and other issues that may affect you regarding the processing of your personal data within the scope of Article 10.

Basic information on the protection of personal data transferred to SystemCloud is given below. SistemCloud, Art. of the Law. PRIVACY AND PERSONAL DATA PROTECTION POLICY

1. DEFINITIONS

Within the scope of Article 3 of the Personal Data Protection Law No. 6698;

  • Data processor: Real or legal person who processes personal data on behalf of the data controller, based on the authority given by the data controller,

  • Data controller: The natural or legal person who determines the purposes and means of processing personal data and is responsible for establishing and managing the data recording system,

2. LEGAL BASIS FOR COLLECTION OF PERSONAL DATA

Protection of personal data is an important issue for SistemNOW Mehmet KONT (SistemCloud). SistemCloud, in order to comply with the Personal Data Protection Law No. 6698 ("KVK Law") (Date of Adoption: 24/3/2016 | Date of the Official Gazette Published: 7/4/2016 Number: 29677) and the legislation on the protection of personal data. The Privacy and Personal Data Protection Policy issued in this context is made available to natural persons whose personal data are processed ("Relevant Person").

Within the framework of the explanations made in the Personal Data Processing Policy, we hereby inform you that you have read and understood this Policy and that you consent to the processing of your personal data, by ticking the boxes you need to tick when registering on the site, you will declare your acceptance.

3. GENERAL PRINCIPLES

In the processing of personal data, it is mandatory to comply with the principles specified in Article 4 of the Personal Data Protection Law No. 6698;

  • Compliance with the law and the rules of honesty:


SistemCloud processes Personal Data in accordance with the relevant legislation and the requirements of the rule of honesty, on a legitimate basis (explicit consent), by adopting the principle of transparency, and uses it within these limits. SistemCloud uses personal data knowing that it should not be used in a way that would have consequences against individuals without a legitimate reason, that transparency should be adopted as a principle in the processing of personal data and that individuals should be informed in this context, and that personal data should be processed in line with the reasonable expectations and predictions of individuals.

  • Accurate and up-to-date when necessary:


SistemCloud ensures that the Personal Data it processes is accurate and up-to-date, taking into account the fundamental rights and legitimate interests of Personal Data Owners. In this context, SistemCloud pays attention to taking reasonable precautions to ensure that personal data is accurate, identifying the sources from which it was obtained, carefully considering requests arising from its inaccuracy, and evaluating whether it needs to be updated. In order for SistemCloud to fulfill its obligations in the legislation, users are required to share accurate and up-to-date data.   • Processing for specific, clear and legitimate purposes:


The principle of processing for specific, clear and legitimate purposes requires SistemCloud to clearly and precisely determine the purpose of data processing and that this purpose be legitimate. Within the framework of this principle, SistemCloud carries out personal data processing activities for specific, clear and legitimate purposes required by its commercial activities.

  • Being related to the purpose for which they are processed, limited and proportionate:


The principle of personal data being limited and proportionate, linked to the purpose for which they are processed, requires that the processed data be suitable for the achievement of the specified purposes, and that personal data that is not related to or not needed to achieve the purpose should be avoided. SistemCloud processes personal data sufficiently to achieve the purposes determined within the scope of its commercial activities. SistemCloud does not process your personal data for areas other than the work it performs and the services it provides.

  • Preservation for the period stipulated in the relevant legislation or required for the purpose for which they are processed (See: Annex: Table):


Personal data must be retained only for the period stipulated in the relevant legislation or necessary for the purpose for which they are processed. Accordingly, if there is a period stipulated in the relevant legislation for the storage of data, data controllers will comply with this period; Otherwise, it will be able to retain the data only for the period necessary for the purpose for which it is processed. In this context, SistemCloud retains Personal Data only for the period necessary for the purpose for which they are processed. If there is no valid reason for further storage of Personal Data by our Company, such data will be deleted, destroyed or anonymized.

4. CONDITIONS FOR PROCESSING PERSONAL DATA

Within the scope of the Personal Data Protection Law, personal data cannot be processed without the explicit consent of the relevant person. However, in cases listed in Article 5/2 of the Personal Data Protection Law, it is possible to process personal data without the explicit consent of the relevant person. As a matter of fact, even if the conditions in Article 5 are met, personal data processing must be carried out in line with the General Principles within the scope of Article 4 of the law and must comply with other provisions of the KVK Law.

In case one of the following conditions exists, it is possible to process personal data without the explicit consent of the relevant person:

  • Clearly prescribed by law.
  • It is necessary for the protection of the life or physical integrity of the person or someone else who is unable to express his/her consent due to actual impossibility or whose consent is not given legal validity.
  • It is necessary to process personal data of the parties to the contract, provided that it is directly related to the establishment or performance of a contract.
  • It is mandatory for the data controller to fulfill its legal obligation.
  • It has been made public by the person concerned.
  • Data processing is mandatory for the establishment, exercise or protection of a right.
  • Data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the person concerned.
  • 5. METHODS AND LEGAL REASONS FOR COLLECTING PERSONAL DATA

    SistemCloud, your Personal Data; It collects audio, electronically or in writing, in accordance with the personal data processing conditions specified in the KVK Law and in line with the legal reasons specified in this Privacy and Personal Data Protection Policy.

    SistemCloud undertakes to take all necessary technical and administrative measures and show due care to ensure the confidentiality, integrity and security of your personal data.

    SistemCloud takes the necessary precautions to prevent unauthorized access to personal data, misuse, unlawful processing, disclosure, alteration or destruction of personal data. To do this, it uses generally accepted security technology standards such as Secure Socket Layer (SSL) encryption.

    6. FOR WHAT PURPOSES ARE PERSONAL DATA PROCESSED?

    SistemCloud may record, store, update, disclose, transfer, classify and process your Personal Data to third parties, with your express consent and in cases and to the extent permitted by the legislation, and will retain it for the period required for these purposes.   • Protection of our Company's legitimate interests, provided that the fundamental rights and freedoms of the data owner are not harmed.
  • 7. TRANSFER OF YOUR PERSONAL DATA

    Although personal data cannot be transferred without the explicit consent of the relevant person within the scope of the KVK Law, it is possible to transfer personal data without the explicit consent of the relevant person, provided that the necessary conditions are met in accordance with the provisions of articles 8 and 9 of the relevant KVK Law. As stated in the KVK Authority guide, data transfers that occur within a legal entity that has the title of data controller cannot be considered as transfers to a third party. When individuals share their personal data with a legal entity, the legal entity has the title of data controller. The exchange of data between employees or different units operating within the legal entity is not a transfer to a third party in this sense.

    9. WHAT ARE YOUR RIGHTS ARISING FROM THE PERSONAL DATA PROTECTION LAW?

    Within the scope of Article 11 of the KVK Law, everyone can apply to the data controller and;

  • Learning whether personal data is processed,
  • Requesting information if personal data has been processed,
  • Learning the purpose of processing personal data and whether they are used for their intended purpose,
  • Knowing the third parties to whom personal data is transferred at home or abroad,
  • Requesting correction of personal data if they are incomplete or incorrectly processed,
  • Requesting the deletion or destruction of personal data within the framework of the conditions stipulated in Article 7,
  • Requesting that the transactions carried out in accordance with paragraphs (d) and (e) be notified to third parties to whom personal data are transferred,

    12. DESTRUCTION, DELETION AND ANONYMIZATION OF PERSONAL DATA
